These terms and conditions of use ("Terms") explain the terms and conditions on which Explore Learning Ltd (referred to as “Explore Learning” or by the words "we", "our", or "us") will provide the user ("you", "your") with access to our website ("Site"), mobile application ("App"), and offline services ("Offline Services") (collectively, our "Services").
By downloading the App, you agree to these Terms. Please read them carefully before using the App or Site. If you do not agree to these Terms, you must not use the App.

2. About the App
The App is designed to strengthen the partnership between Explore Learning and families by giving parents and carers greater clarity, insight, and connection to their child's learning journey.
With the App, you can:
View personalised session feedback instantly after every session.
Track progress towards academic goals through easy-to-read graphs.
Manage upcoming bookings for learning sessions and progress meetings.
Receive tailored insights and guidance through our AI Coach, helping you better support your child's learning at home.
The App is currently available for parents and carers only, and for private domestic use.
Important: The App and AI Coach provide general educational guidance and insights only. They are not a substitute for professional educational advice, assessment, or teaching.
Operating system requirements
This app requires a compatible device and supported operating system. Supported platforms (e.g., iOS version X and above, Android version Y and above) are published on the Apple App Store and Google Play and may change over time.
3. User Accounts and Eligibility
You must be 18 or over to use our Services.
Accounts are provided only to paying Explore Learning members using the email registered in our customer database.
Children cannot create or access accounts.
Parents/carers must manage their own logins and must not share credentials with others.
By using the Services, you confirm that:
You are authorised to enter into this agreement.
You will use the Services only for lawful purposes.
All information you provide is accurate and not misleading.
You will not introduce viruses, malicious code, or attempt to gain unauthorised access to our systems.
You will keep your account details secure and notify us immediately of any suspected unauthorised access.
We reserve the right to verify your identity and membership status to maintain account security.
4. Content, Data, Intellectual Property
Data Controller
Explore Learning Ltd is the Data Controller of your personal data processed through the App and Site. All processing is carried out in accordance with our Privacy Policy and applicable law, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
Data Processing
The App collects usage metrics and interaction data with the AI Coach to improve user experience and service performance.
Academic progress data is displayed in the App but stored securely in our internal systems.
Personal details are managed in our customer database. Future updates may allow editing directly in the App.
Interactions with the AI Coach may be analysed to improve our products and services. Such analysis is performed using anonymised or aggregated data. Personal data is not used to train machine learning models without your explicit consent.
Ownership of Data and Content
As between you and us, you retain ownership of your and your child's personal and academic data provided or collected by you.
We retain ownership of all derived data, including analytics, aggregated usage data, performance metrics, and any AI-generated insights, guidance, or predictions produced by our systems.
We grant you a limited, non-exclusive, revocable licence to use the insights and related material solely for your personal, non-commercial use.
Ownership of intellectual property
As between you and us, all intellectual property rights in the App, the related documentation and the Services throughout the world belong to us absolutely. The rights in the App and the Services are licensed (not sold) to you.
You have no intellectual property rights in, or to, the App, the documentation or the Services (other than the non-exclusive, revocable right to use them in accordance with these Terms).
5. Use Restrictions
In return for agreeing to comply with these Terms, you may:
download or stream a copy of the App onto a device, and view, use and display the App for your personal purposes only;
use any documentation supplied to support your permitted use of the App;
receive and use any free supplementary software code or update of the App incorporating patches and corrections that we may supply.
You may not:
download, copy, reproduce, distribute, sell, lease, sub-license, otherwise make available, or commercially exploit any content or data from the App or our Services;
save strictly to the extent permitted by law, reverse engineer, scrape, or extract data from the App or related systems;
misuse the Services by introducing malicious software or overloading systems, or by interfering with normal operation;
transfer the App or your account to someone else;
translate, merge, adapt, vary, alter or modify the App (or permit the same);
use the App in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these Terms, or act fraudulently or maliciously;
infringe our intellectual property rights or those of any third party in relation to your use of the App;
transmit any material that is defamatory, offensive or otherwise objectionable in relation to your use of the App; or
use the App in a way that could damage, disable, overburden, impair or compromise our systems or security or interfere with other users.
Any unauthorised use may violate our intellectual property and applicable laws.
6. Liability and Disclaimers
Non-excludable liability: We do not limit or exclude our liability where it is unlawful to do so (for example, for death or personal injury caused by negligence, or for fraud).
No implied warranties: The Services are provided "as is" and "as available", without any guarantees of uninterrupted access or freedom from errors or harmful code.
AI guidance disclaimer: AI-generated responses and insights are for general educational guidance only. We do not guarantee their accuracy or suitability for your specific circumstances.
Service interruptions: Access may be temporarily suspended for maintenance or due to technical issues. We are not liable for such downtime.
Third-party content: The App may contain links to other independent websites which are not provided by us. Such independent sites are not under our control, and we are not responsible for and have not checked or approved their content. You must make your own judgment about whether to use any such independent sites, including whether to buy any products or services offered by them. We are not responsible for the actions or content of third parties you interact with through the App or Services.
Indirect or business losses: We are not liable for any indirect, consequential, or business-related losses, including lost revenue, profits, contracts, or data.
Performance: We make no warranty as to your child’s performance and have no liability for such.
7. Termination and Suspension
We may suspend or terminate your access if you breach these Terms, and we may take action including but not limited to:
Written warnings
Temporary or permanent withdrawal of your account
Legal action
Disclosure of relevant information to law enforcement organisations
You may close your account and request deletion of your data at any time by contacting enquiries@explorelearning.co.uk. Any request for deletion would be addressed in accordance with our Privacy Policy and the law.
Following termination, data will be retained or deleted in accordance with our Privacy Policy.
8. Changes to these terms
We may update these Terms at any time. If changes are material, we will notify you via email or through in-app messaging.
The effective date and last updated date will always be displayed within the App or Site. By continuing to use the Services after notice, you accept the revised Terms.
9. Governing Law and Disputes
These Terms are governed by the laws of England and Wales.
If a dispute arises, where possible we will usually first seek to resolve it informally. If unresolved, the courts of England and Wales shall have exclusive jurisdiction. However, if you are a resident of Scotland or Northern Ireland, you or we may bring proceedings in your country of residence.
10. Other Relevant Provisions
No rights for third parties
These Terms do not give rights to anyone other than you and us to enforce any part of them.
Partial unlawfulness
Each paragraph of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
Delays in enforcement
Even if we delay in enforcing these Terms, we can still enforce them later. If we do not insist immediately that you do anything you are required to do under these Terms, or if we delay in taking steps against you in respect of a breach, you must still do that thing, and it will not prevent us taking steps against you at a later date.

Under data protection legislation, we are required to provide you with information, including in relation to who we are, how and why we process your personal data, and your rights in relation to your personal data and how to exercise them. Terms and Conditions of Service
If you purchase our services, our Standard Terms and Conditions of Sale will apply to this.
